1. Services
1.1 In this Terms and Conditions, "Service(s)" refer to online payment for purchase of StarHub Mobile Prepaid SIM Cards ("SIM Card") provided by StarHub Mobile Pte Ltd (Reg. No. 200000646C) ("StarHub") on www.starhub.com.
1.2 On behalf of StarHub, StarHub's service provider, Financial Link (S) Pte Ltd (Reg. No. 201523776D) ("Financial Link") will provide a payment gateway through which you can order and make payments for the SIM Cards.
1.3 Financial Link is not authorised to act on behalf of StarHub or its affiliates in relation to any other transaction or service.
2. Acceptance of Terms and Conditions
2.1 These Terms and Conditions will apply when you access the Services. Before proceeding to use the Service, please read these terms and conditions carefully. If you are unable to accept these Terms and Conditions, please do not proceed further.
3. Provision of the Service
3.1 These Terms and Conditions apply on every occasion that you use the Services. We may decline acceptance of your transaction at our discretion.
3.2 By using this Service, you acknowledge and agree that any information that you provide may be disclosed to Financial Link and the relevant payment service providers to facilitate provision of the Services. Financial Link's use of your information will be subject to Financial Link's Privacy Policy.
3.3 You represent and warrant that all information that you provide to us and Financial Link in connection with the Service, will be complete and accurate in all respects and you acknowledge that we and Financial Link are wholly reliant on the accuracy of the information you provide and will rely on it in the provision of the Services to you.
3.4 In order to use this Service, you must supply a valid credit or debit card and you must provide certain information to us to enable Financial Link to validate your identity and verify that you are the owner of, or an authorised user of, such credit or debit card(s). You will also have to provide Financial Link with details such as your postal address, and a valid email address. The information that you provide may be validated against information we already have on file that is associated with you, your credit or debit card, your bank account, your StarHub account, or information we receive from one or more third parties, or information maintained by a third party. If you are unable to provide adequate information for us to validate your identity, we have the right to not allow you to use the Service. You warrant that the information is correct and that you have the legal right to use all of the credit or debit cards and all of the bank accounts you use for this Service.
4. Your use of the Services
4.1 You are responsible for obtaining any equipment required for your use of the Services, including a suitable computer with internet access and web browser and any other items of hardware or communications equipment necessary to enable you to access and use the Services. You acknowledge and agree that the ownership in any intellectual property rights (including, for the avoidance of doubt, copyright) in this website and Service belongs to us or our licensors. Accordingly, any part of this website (or its source HTML code) may not be used, transferred, copied or reproduced in whole or in part in any manner other than for the purposes of utilizing this website meaning that you may only display it on your computer screen and print it out on your printer for the sole purpose of viewing its content.
4.2 You can use the Service to pay for the SIM Cards you have ordered.
5. Charges and payment
5.1 By placing your order, you authorise Financial Link to process the order by your chosen payment method. Transactions will appear on your bank account as "StarHub Prepaid".
5.2 If we are unable to collect payment through your chosen payment method, the order will not be successful.
5.3 We may set an upper limit of total amounts you may order, and reserve the right to amend this limit at any time without notifying you.
5.4 You must not knowingly order a Service when there are insufficient funds in your bank account or insufficient credit on your credit or debit card to allow Financial Link to collect payment successfully on behalf of StarHub.
5.5 Where an order to purchase a SIM Card has been placed and accepted, you will not be able to cancel that order or obtain a refund.
5.6 You understand and accept that when you place an order for SIM Cards at the StarHub Pre-Order webpage, certain credit card companies may impose a cross-border charge on the payment transaction. Please check with your relevant credit card company on the applicable charges, terms and conditions. Depending on the policy of the relevant credit card company that you use, you may or may not receive prior notice of the cross-border charge.
6. Use of your information
6.1 When you provide us with details of your credit and / or debit cards during the order process, they may immediately be authenticated online by the card issuers, using our secured facilities. You acknowledge and agree that changes to the details of your credit and/or debit cards may be immediately authenticated on line by the card issuer.
6.2 Payment details you provide during the order procedure will be encrypted and stored on a secured server.
6.3 We reserve the right to restrict your access to the Service, should we and/or Financial Link consider that the activities or the changes of personal or payment data breaches the business rules associated to the Service. The business rules monitor changes made to your personal and payment details, the volume and value requested and the failure of collection of payment for the authorised order.
6.4 You agree that we may communicate with you on a regular basis via email or SMS to provide requested Services, inform you regarding your transactions and we also may communicate by phone to resolve complaints or investigate suspicious transactions. We may use your email address to notify you of transactions when carried out. You also agree that we may use your email address to send you information about important changes to our products and services, and to send notices and other disclosures required by law or payment scheme rules.

9. Liability
9.1 The Services are provided on an "as is" and "as available" basis and you agree that you use the Services or rely on any content obtained through the Services at your sole risk. We expressly disclaim all warranties of any kind, whether express or implied, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose and non-infringement, to the fullest extent allowed by law. No advice or information whether oral or written, obtained by you from us or through the Services will create any warranty not expressly set out in this Terms and Conditions.
9.2 Without prejudice to Clause 9.1 above, we make no warranty:-
9.3 Except as set out in this Terms and Condition, we expressly exclude all other liability we may have to you, including all liability in contract, tort, negligence, misrepresentation, strict liability or statute. This exclusion applies for our benefit and that of Financial Link or other service providers whose networks are connected to each other or to this Service, all companies, directly or indirectly owned, wholly or partly owned or controlled by us or any of these parties, and all their officers, employees, contractors and agents or anyone else to whom we or these parties are responsible ("the Relevant Parties") and whether it relates to anything caused by or resulting from anything any of the Relevant Parties does or omits to do or delays in doing (even if done, omitted or delayed wilfully, recklessly or negligently), whether or not it is contemplated or authorised by any agreement you have with us.
9.4 Under no circumstances will we or any of the Relevant Parties be liable for any special, incidental, indirect, consequential or punitive damages, losses, costs or expenses, even if such damages, losses, costs or expenses were caused wilfully, recklessly or negligently.
9.5 Under no circumstances will we or any of the Relevant Parties be liable for any lost profits, revenue, business or anticipated savings, even if such damages, losses, costs or expenses were caused wilfully, recklessly or negligently.
9.6 If we or any of the Relevant Parties are liable to you and we cannot, for any reason, rely on the exclusion of liability set out above, then in no event will our liability for damages, losses, costs or expenses suffered or incurred by you and anyone else (whether in contract, tort, negligence, misrepresentation, strict liability or statute or otherwise) exceed S$1,000/- in any 12-month period.
9.7 StarHub may perform any of its obligations or exercise any of its rights under this Terms and Conditions by itself or through StarHub's affiliates.
10. Indemnity
11.1 You must indemnify us and our affiliates, employees, directors and agents against all claims, damages, losses and liabilities resulting from your use of the Services, your negligence, omission, act or breach of this Terms and Conditions.
11. Other Terms and Conditions
11.1 In addition to these Terms and Conditions, you agree that StarHub Consumer General Terms and Conditions, any applicable Service Specific Terms and Conditions, and StarHub's Data Protection Policy (collectively "StarHub Terms") shall apply.
11.2 We may from time to time change any of these Terms & Conditions (including the StarHub Terms) and/or such other terms and conditions agreed or accepted by you (including, without limitation, our tariffs, price plans, charges and payment terms). We may also from time to time withdraw, suspend, or change any of the Services. We endeavour, where reasonably practicable, to give you reasonable advance notice of such changes. We will notify you of such changes through written notice, electronic mail, our bill, our website or such other form as we may deem appropriate. You agree that the display of the revised Terms & Conditions (including the StarHub Terms) on our website will constitute notice of the changes. Your continued use of the Services will constitute acceptance of the changes.
